Excelsior Springs City Council acts to clarify special use permit rules

EXCELSIOR SPRINGS – The city has clarified special use permit rules. The council addressed permit-holders’ failure to comply “with any special conditions imposed at the time of approval” and preservation of “the public health, safety and welfare,” per an approved ordinance. City Planner Logan Sours said he supported the change “because the explicit authority to revoke a special use permit is not explicit in our city code.” “That right has always been there,” Sours said. “But this is just to add clarity to it.” Such clarity will allow the city to revoke special use permits, he said. “This is a very rare action,” Sours said. “But ... it’s important to have these zoning texts in place.” Sours mentioned a special use permit for property on Milwaukee Street. The council agreed to give the owner a 30-day grace period “to bring the property into compliance with all city codes and satisfy the stipulations set out in the original ordinance,” as Sours stated in a March 2 memo to city leaders…
